Terms of Service

These Terms of Service govern access to Pixion Film AI Studio at studio.pixionfilm.com.au (the Service), operated by Pixion Film Pty Ltd (Pixion Film, we, us or our). By creating an account or using the Service, you agree to these Terms.

Use of the Service

The Service provides AI-assisted image, video, music, character voice and production-planning tools. You must be legally capable of entering into these Terms and must use the Service only for lawful purposes. You are responsible for the prompts, uploads, generated outputs, projects, API activity and other actions associated with your account.

Accounts and Credits

You must provide accurate account information, keep your sign-in credentials secure and promptly notify us of suspected unauthorised use. When creating an account, including with Google, you must actively accept the Terms presented during registration. We record the acceptance time and version.

Generation and other metered actions may require Credits. The Service displays or returns a quoted Credit cost before a generation is submitted. The final charge is calculated by our server from the validated model, workflow, duration, resolution and other applicable parameters. Credits are service-use units, have no cash value, are not transferable between accounts and cannot be exchanged for cash except where required by law.

A chargeable job that fails before producing a completed result, or that is confirmed as cancelled by the Service, is automatically refunded once according to the billing record. A successfully completed generation remains chargeable even if its creative result does not meet your subjective preference. This policy does not limit any remedy that cannot lawfully be excluded under the Australian Consumer Law.

We may change prices, Credit rates, free allowances, storage limits or service limits prospectively. The quote shown for a submitted job applies to that job. Purchased Credits and payment transactions may also be subject to the checkout provider's terms.

Acceptable Use

You must not use the Service to create, upload, request or distribute content that is unlawful, abusive, infringing, deceptive, harmful or otherwise violates applicable platform rules or laws. You must not attempt to bypass access controls, regional restrictions, account limits, billing, safety controls or server security; interfere with other users or infrastructure; introduce malicious code; scrape private data; or use another person's account without permission.

We may remove content and restrict, suspend or terminate access where misuse, security risk, non-payment or a material breach is detected. Where reasonably practicable, we will provide notice and an opportunity to address the issue, but we may act immediately to protect users, infrastructure, legal rights or the Service.

Third-Party Models

Use of a model is also subject to the applicable third-party model licence and acceptable-use restrictions listed on our Model Licenses page. By selecting and using a model, you agree to comply with the restrictions that apply to you and your intended use. Model access does not represent a warranty that a particular output or downstream use is legally cleared for your intended purpose.

Available models may change over time. We may restrict, replace, or withdraw a model where required for licensing, safety, operational, or compliance reasons.

MiniMax H3 is unavailable under its community licence in the European Union, United Kingdom, Republic of Korea, and United States. You must not access, generate with, use, display, or distribute MiniMax H3 or its outputs in those territories unless separately authorised by MiniMax. When MiniMax H3 content is distributed in a public environment, you must clearly and prominently disclose that it is machine-generated. MiniMax H3 and its outputs must not be used to improve another artificial intelligence model, except as expressly permitted for MiniMax H3 derivatives under its licence.

Music, Audio and Voice

You must hold all rights, licences, permissions, and consents required for lyrics, compositions, recordings, samples, performances, reference audio, voice recordings, and other materials you submit or use. You are responsible for any reproduction, adaptation, synchronisation, distribution, public performance, publicity, privacy, and other rights required for your outputs and their intended use.

You must not clone, imitate, design, or use a real person's voice without that person's informed consent or another lawful basis. You must not use generated or cloned voices to impersonate, deceive, defraud, harass, or falsely imply endorsement. Pixion Film may request evidence of consent, restrict voice features, remove content, or suspend an account where misuse is suspected.

Audio and voice models may impose model-specific attribution, acceptable-use, disclosure, or downstream commercial-use requirements. These requirements are summarised on the Model Licenses page. The official model licence controls if a summary differs from it.

Content Rights

You retain responsibility for ensuring you have rights to any prompts, uploads, references, or other materials you submit. Generated outputs may be affected by third-party model, workflow, and platform terms. You should independently review rights and clearance requirements before commercial use.

You retain your rights in content you submit. You grant Pixion Film a limited, non-exclusive licence to host, copy, process, transmit, display and modify that content only as reasonably necessary to operate, secure, support and improve the Service, fulfil your generation requests and comply with law. This licence ends when the content is deleted, except for retained backups, transaction records, legal obligations and content that must be preserved to resolve a dispute or enforce these Terms.

AI outputs may be similar to content generated for other users and may not qualify for intellectual-property protection. We do not promise exclusivity, originality, accuracy, identity consistency or legal clearance. You must review outputs before publication or reliance.

Privacy and Data

Our Privacy Policy explains how Pixion Film Pty Ltd collects, uses, discloses, stores and deletes personal information. You control which prompts and assets you submit and should not upload confidential, regulated or sensitive information unless you are authorised to do so and the Service is appropriate for that use.

Availability

The Service is provided on an as-available basis. Generation jobs may fail, be delayed or produce unexpected results due to model behaviour, infrastructure limits, queue capacity or upstream service changes. We may maintain, modify, suspend or discontinue features and models. You should download or otherwise retain copies of important outputs and source materials.

Disclaimer and Liability

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Subject to those non-excludable rights, the Service and AI outputs are provided on an as-available basis without a guarantee of uninterrupted availability, fitness for a particular purpose, accuracy or error-free output. To the extent permitted by law, Pixion Film Pty Ltd is not liable for indirect, incidental, special or consequential loss arising from use of the Service.

Changes to These Terms

We may update these Terms to reflect changes to the Service, law, licensing, safety or business operations. We will publish the updated version and effective date. If a material change requires renewed consent, we may ask you to accept the updated Terms before continuing to use the Service.
